California Proposition 65 Compliance Statement

Also known as the "California Safe Drinking Water and Toxic Enforcement Act".

PROPOSITION 65 APPLIES TO COMPANIES SELLING PRODUCTS IN THE STATE OF CALIFORNIA AND REQUIRES COMPANIES TO PROVIDE CLEAR WARNINGS IF ANY OF THE LISTED CHEMICALS ARE PRESENT IN THE PRODUCT BEING SOLD. THERE ARE CURRENTLY OVER 900 CHEMICALS CONTAINED IN THIS LIST AND IT IS UPDATED ANNUALLY BY THE STATE OF CALIFORNIA.

The way that Proposition 65 is structured makes it nearly impossible to ascertain with 100% scientific certainty whether a specific product we manufacture, repackage, or distribute requires a warning for the chemicals present on the list. While we do know that one or some of the current chemicals listed are present, we do not always know how our products will be used or altered before they are distributed to the end customer. It is for this reason that we are unable to determine if our current products violate the exposure hazard. As a result of steep penalties for non-compliance, and because there is no penalty for providing an unnecessary warning, ToneSpeak (like many other companies doing business in California) decided to provide the Proposition 65 notice out of an abundance of caution.

This and other notices regarding Proposition 65 are an effort on our part to comply with the labelling and notification requirements. The warning does not mean that our products will necessarily cause cancer, birth defects, or other reproductive harm. We believe our products, when used as designed, are not harmful. We provide the below warning in order to comply with this California right-to-know law and the OEHHA updates made to the labelling requirements in 2016.
